Anyone making a submission is required to disclose any reportable political donation, or any gift to any local Councillor or employee of Council. Please be advised that all submissions received in response to the exhibition will be available as a public record.

A Voluntary Planning Agreement (VPA) is an agreement entered into by a planning authority (such as the Department of Planning and Environment), and a developer.

Under the Agreement a developer agrees to provide or fund:

• public amenities or services
• affordable housing
• transport or other infrastructure.
  

Contributions can be made through:

• dedication of land
• monetary contributions
• construction of infrastructure
• provision of materials for public benefit and/or use

VPAs cannot be entered into unless public notice has been given and an explanatory note is made available for inspection for at least 28 days.

On 23 August 2012, the NSW Planning and Assessment Commission issued a concept approval for the development of land at 566 - 594 Princes Highway, Kirrawee, commonly referred to as the "Brickpits".  A condition of that concept approval requires a Biodiversity Offset Package to be implemented.

Because the Sydney Turpentine Ironbark Forest is an Endangered Ecological Community a condition of the concept approval requires that a Biodiversity Offset Package be implemented to compensate for the approved loss of the Sydney Turpentine Ironbark Forest.

Biodiversity Offset Package addresses the retention and enhancement of some of the Sydney Turpentine Ironbark Forest on the land subject to the development. It also requires compensatory planting to occur off that land in existing parks and reserves throughout the Shire.

Details of the locations and extent of the off-site plantings are fully described in the proposed Voluntary Planning Agreement

The Biodiversity Offset Package is in accordance with the Biodiversity Management Plan prepared by Cumberland Ecology dated November 2011 and the Off-Site Compensatory Bushland Planting Report by AECOM dated 27 November 2014.

Sutherland Shire Council and South Village Pty Ltd propose to enter into a Voluntary Planning Agreement (VPA), in accordance with Section 93G(1) of the Environmental Planning and Assessment Act 1979.
