Planning Proposal: C3 & C4 Zone Review and Revision of Dual-occupancy Controls

Council resolved to draft a planning proposal to amend the Sutherland Shire Local Environment Plan 2015 at its meeting on 11 December 2023. The amendments have been reviewed and a comprehensive study prepared, along with the Planning Proposal. The Department of Planning, Housing and Infrastructure granted approval on 10 June 2025 for Council to proceed to public exhibition.

The draft Planning Proposal identifies five small precinct areas for rezoning from C3 Environmental Management or C4 Environmental Living to R2 Low Density Residential.

The areas proposed for rezoning are:

  • Caringbah South (Precinct 3)
  • Kangaroo Point (Precinct 4)
  • Kareela (Precinct 5)
  • Oyster Bay (Precinct 7)
  • Yowie Bay (Precinct 8).

The draft planning proposal will also allow:

  • Torrens title subdivision where currently only strata-subdivision is available in C4 Environmental Living
  • Two-storey dual occupancies on internal lots - currently only single storey dual occupancies are allowed.

The amendments allow for more flexibility and delivery of housing options in Sutherland Shire.

Next steps

Following community consultation, Council will review and consider all feedback received. A report will be prepared for elected Councillors. The Local Environmental Plan will be amended if the proposal is supported.

  • Project update - October 2025

    The Planning Proposal C3 and C4 Zone Review Post Exhibition Report was submitted to the elected Council at its meeting on 13 October 2025. During the meeting, Councillors voted on the proposal, and the motion was declared lost.

    As a result, no changes will be made to the zoning or dual-occupancy controls of the identified sites, which will remain zoned C3 Environmental Management or C4 Environmental Living at this time.
