What is a Voluntary Planning Agreement (VPA)?

    A Voluntary Planning Agreement (VPA) is a written agreement between a planning authority (council) and a developer who wishes to make contributions to the planning authority as part of a development application or has sought to vary an environmental planning instrument. Contributions can be made through:

    • Dedication of land, at no cost to council
    • Provide a public material or benefit to be used for a public purpose, at no cost to council
    • Pay a monetary contribution.

    It is important to note that planning decisions cannot be ‘bought’ or ‘sold’. Council must undertake its statutory functions, including the merit assessment of applications, not based on planning benefits offered by applicants.

    What is the Aliro Development?

    The Aliro development is located at 13 Endeavour Road Caringbah. The VPA is a part of the most recent application, DA23/0721.

    DA23/0721 involves the demolition of 2 existing buildings, and construction of 8 new buildings with uses including warehouse and distribution, light industrial, industrial retail outlet, commercial, childcare and café, provision of estate domain works including roads and footpaths, new carparking and landscaping works and operation of the site 24 hours per day 7 days per week. 

    What is the Aliro VPA?

    This VPA requires that Alirio make two contributions to council.

    1. Signalisation (traffic lights) of the intersection between Endeavor Road and Captain Cook Drive, at no cost to council. This is to minimise the impact of new traffic generation as a result of the development.
    2. Dedication of land to the north of the Endeavour and Gannon’s Road Roundabout, at no cost to council. This area is currently used as a slip lane to access Solander Fields. Dedicating this land to Council ensures that public access to the fields is maintained into the future.

    The total cost of these works is $3,367,891. This exceeds what would have been normally required by s7.12 monetary contributions (approx. $1.48 million) and as such, Council is offering to waive the s7.12 contributions.

    How is this VPA in the public interest?

    The offer is for the signalisation (traffic lights) at an intersection and dedication of land to Council, estimated to be at a cost of $3,367,891. This is more than the value of the s7.12 contribution, of approximately $1.48 million. The signalisation of the Captain Cook Drive and Endeavour Road intersection and the dedication of the roundabout and associated land assures access to Council’s Solander playing fields car park and will improve the capacity and safety of transport in the area. As such, there is a measurable public benefit.

    How will the VPA be processed?

    This VPA will be processed by Council, after public exhibition. A report will be considered by Council, including the summary of submission received during exhibition. As part of the VPA, the developer will ensure the works meet relevant constructions standards. 

    Why is Council seeking feedback?

    Clause 204 of the Environmental Planning and Assessment Regulation Act of 2021 requires that Council provide public notice, and allow public inspection, of any proposed VPAs. This is to allow community feedback on the proposal, and ensure these inputs are reflected in the final decision by the South Sydney Planning Panel.
