What is a Planning Agreement (PA)?

    A Planning Agreement (PA) is an agreement between a planning authority and a developer. It must be linked to a planning-related application (such as an application to begin construction on a development or change a site’s zoning or planning controls).  

    They are sometimes also known as Voluntary Planning Agreements.

    Planning agreements can require a developer to provide land, monetary contributions or material public benefit to be used or applied towards a public purpose.

    What is Council exhibiting?

    We are exhibiting a draft Planning Agreement for in relation a development at 544-550 Box Road, Jannali. The development was approved in April 2026.

    The approved development involves the demolition of existing structures and construction of a mixed-use development including residential apartments, centre-based childcare, a medical centre, and commercial and retail. The development is currently under construction.

    The site’s rear boundary adjoins Leopold Lane, which currently does not have a formed pedestrian footpath.

    The development approval included a condition requiring improvements to this lane, including land dedication and associated public domain works.

    The draft Planning Agreement will implement this condition.

    What work does the draft Planning Agreement support?

    The draft Planning Agreement is proposed to be between 3Gen Ltd and Jannali No. 1 Pty Ltd (collective developer of 544-550 Box Road site) and Sutherland Shire Council.

    At its September 2026 meeting, Council endorsed placing this draft agreement on exhibition.

    This draft agreement requires that the developer will complete the following:

    • dedication of part of the subject land to Council, comprising a 1.5 metre wide strip adjoining Leopold Lane for the full length of the relevant frontage for a total of approximately 45 square metres of land; and
    • delivery of road widening works, including footpath, kerb and gutter improvements, with the works to be completed and land dedicated prior to the issue of an occupation certificate.

    What are the benefits of the works?

    The draft Planning Agreement will support the construction and dedication of a new footpath along this section of the lane. This will make it easier for pedestrians to safely use the lane to move around Jannali.

    The agreement will also marginally increase the lane’s road surface width, and in doing so ensure the lane continues to play an important role servicing the needs of local businesses.

    In summary, this work will create a modern and safe public domain that will support the accessibility and future function of the Jannali centre, in line with the Jannali Development Control Plan and Jannali Public Domain Plan.

    What is the estimated cost of the works?

    The total cost of these works is estimated to be between $25,000-$30,000, with estimated value of the land between $50,000 - $65,000. The conservative estimated total value is therefore approximately $95,000.

    When will the work take place?

    The draft Planning Agreement, if executed, will become a legal commitment between Council and the developer.

    The draft agreement states the work must be completed, and land dedicated to Council, prior to any Occupation Certificate being issued for the development. In other words, the works must be completed and dedicated before the development can be sold or tenanted.

    Are you seeking feedback on the design of the proposed improvements to Leopold Lane?

    No we are not, given that the detailed design of these proposed improvements has already been incorporated into the approved development.

    What we are seeking feedback on is the proposed mechanism to deliver these works.


    Who will own the new footpath?

    Council will gain public ownership of the new footpath, as the works require dedication of the finished footpath and associated public domain works.

    Will the developer be paying monetary development contributions for this site, along with the lane dedication and works?

    As mentioned above, we conservatively value the works in the draft Planning Agreement as being worth around $95,000.

    The estimated monetary value of the offer is broadly comparable to the $92,000 development contribution which would otherwise apply to the development.

    In addition, the draft Planning Agreement provides additional strategic value through the direct delivery of land dedication and infrastructure improvements that align with Council’s adopted planning framework for Jannali town centre.

    Finally, a condition of the development consent stated that, if the draft Planning Agreement was entered into, then a contribution would not be payable.

    Given these above reasons, we are not proposing to charge a development contribution for this site.

    When will all of Leopold Lane be widened and have footpaths?

    This is a long-term strategic planning objective, which will take place as sites are redeveloped.
