Amended Voluntary Planning Agreement with Breen Resources
Council is seeking community feedback on a proposal to amend an existing Voluntary Planning Agreement (VPA) signed between Sutherland Shire Council and Breen Resources in 2023.
This agreement required the embellishment of the proposed Marang Parklands, which when complete will represent 91 hectares of public open space and environmental conservation land on the Kurnell peninsula.
The 2023 agreement was contingent on the approval of a State Significant Development (SSD) application by Breen for a new resource recovery facility.
The 2023 agreement required Breen Resources to complete the embellished Marang Parklands by 31 May 2026, subject to any construction-related delays.
However, the assessment and determination timeframe for the SSD application extended beyond the original schedule. As a result, the proponent has submitted proposed amendments to the VPA to reflect this construction-related delay.
At its December 2025 meeting, Council considered revised amendments to the VPA, including changes to the timing of key activities to reflect construction-related delays, the introduction of a firm commencement date, and an additional payment of up to $500,000 by Breen Resources to address the delayed delivery of the parklands.

Next steps
Following community consultation, Council will carefully review and consider all feedback received. Based on this input, amendments may be made to the VPA prior to finalisation.
