Sutherland Shire Section 94 and Section 94A Plan 2016

The plans were adopted and in force on the 1st of January 2017.

On the 21st November 2016 Council adopted Draft Sutherland Shire Section 94 and 94A Development Contributions Plans 2016 (PLN003-17). These contribution plans will apply from 1st January 2017, for development and complying development applications.

The anticipated increased population in the Sutherland Shire will result in a greater demand for infrastructure which cannot be accommodated by existing facilities. The Section 94 and 94A Plans allow Sutherland Shire Council to levy development to provide funds for the infrastructure such as playing fields needed as a result of development.

The Section 94 and 94A Plans allow Sutherland Shire Council to levy development to provide funds for the infrastructure such as playing fields needed as a result of development.

The Section 94 Plan 2016 will impose an open space levy on new dwellings in the precincts where the greatest population growth is anticipated. The main growth precincts are the centre and high density residential flat zones where development of residential flats could occur, with a corresponding increase in residents. These are: Sutherland/ Kirrawee, Miranda, Caringbah, Cronulla, Engadine, Gymea, Jannali, and Sylvania Southgate.

The Section 94A Plan 2016 will impose a levy on all other development with value over $100,000 in all areas of the Sutherland Shire. The projects to be funded under this plan are varied in type and will be distributed across the Sutherland Shire.
