Why is this policy being updated now?

    To compliment the Compliance and Enforcement Policy adopted in May 2021 and provide a framework of guiding principles, transparent methods to assess and clear response options to address illegal use of public land.

    What is the purpose of this policy?

    The purpose of this policy is to provide principles to guide Council operations and decision making in relation to encroachments on Council owned or managed land including Road Reserves.

    This policy is used when an encroachment occurs on:

    • land classified as Community or Operational land under the Local Government Act 1993

    • Crown Land for which Council is the Crown Land Manager under the Crown Land Management Act 2016

    • other land for which Council has a form of care, control and management

    • dedicated public road including “footway” as defined under the Roads Act, 1993 that are not under the control of Transport for NSW (excluding Outdoor Dining, Shopfront Display or A-frame use).
